I never heard of a fish annd wildlife easement. Can you briefly explain? Were you or a previous owner compensated for the easement.? By the state?
Federal Government through FWS took out easements on wetlands. No drainage allowed. When these wet areas expanded, the FWS said they had an easement on the entire quarter, not just the original easement acres. FWS lost in court and now they only have jurisdiction over the original easement acres.
Acting like the FWS had jurisdiction over the entire quarter found many farmers putting their land into a grass program and giving up.
Another downside, these easements are 99 year renewable. It will be another 30 or so years until the landowners will see if they get paid for the renewal or not. I can’t imagine FWS letting the easement go without renewing it.
