So then Ross could just become a company of Mexico and bypass the tax. So now rather than a US company manufacturing in a foreign country, the company just leaves all together and sells into the US market. Meanwhile, companies who do actually manufacture here have their designs purchased and copied. (This happens now) And the foreign company can now sell the copy back into the US at a significantly lower price.
How is an offshore tax penalty different from tariffs?
